This can be done through the Howey Test which defines an investment contract as an ‘investment of money, in a common enterprise, with a reasonable expectation of profits, to be derived from the efforts of others.’ The SEC is using this to argue that XRP should be classified as a security, as part of its wider belief that most of the cryptocurrencies circulating in the market should be classified as securities.
Naturally, Ripple has refuted SEC’s allegations, stating that selling XRP was not an investment contract as no contract was signed during transactions and that XRP does not meet the parameters of the Howey test.
If Ripple wins, this could spark a major boom in crypto buying and XRP in particular could witness a price surge.On the other hand, the ramifications of a court victory for the SEC could be potentially fatal for the cryptocurrency industry.
Shanghai Upgrade Will Help Ethereum Users Enormously
